Terms of Service

1. About these Terms

These Terms of Service (“Terms”) govern your use of Everyday Resilience (“the Service”), operated by the Everyday Resilience team (“we”, “us”, “our”). By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. The Service

Everyday Resilience is an online tool that helps households assess their emergency preparedness across ten domains (water, food, energy, shelter, health, communications, financial, evacuation, community, and security) and provides a personalised action plan.

The Service is not professional emergency management advice.Information provided is general in nature and intended to support — not replace — guidance from emergency services, your local council, and official government preparedness resources such as Get Ready Queensland, NSW SES, DFES Western Australia, and the Australian Government’s Emergency Management Australia programme. Always follow instructions from emergency services during an actual emergency.

3. Accounts

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@everydayresilience.app if you believe your account has been compromised.

You may not create accounts on behalf of others without their permission, and you may not use the Service for any unlawful purpose.

4. Free and Paid Features

The Service offers a free tier that includes a complete household assessment, an overall resilience score, and a limited number of recommendations. Upgraded features — including a full prioritised action plan, all recommendations with cost estimates, and PDF reports — require a paid upgrade.

Pricing is displayed on the Service and may change over time. Changes will not affect any lifetime plan you have already purchased.

5. Payments

Payments for paid features are processed by Lemon Squeezy. By purchasing an upgrade you also agree to Lemon Squeezy’s terms of service. All prices are in Australian dollars and include GST where applicable.

Lifetime plans are non-refundable except where required by Australian Consumer Law. If you believe you are entitled to a refund under Australian Consumer Law, please contact us at hello@everydayresilience.app.

6. Acceptable Use

You agree not to:

  • Use the Service in any way that violates applicable Australian or international law.
  • Attempt to gain unauthorised access to any part of the Service or its underlying infrastructure.
  • Reverse-engineer, decompile, or extract source code from the Service.
  • Use automated tools to scrape, crawl, or bulk-query the Service without our written consent.
  • Resell or redistribute the Service without authorisation.

7. Intellectual Property

All content, software, and trademarks associated with Everyday Resilience are owned by us or our licensors. Your assessment data, household information, and action plan content belong to you. We grant you a limited, non-exclusive licence to use the Service for personal, non-commercial household preparedness purposes.

You grant us a limited licence to store and process your data solely to provide and improve the Service, as described in our Privacy Policy.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or that assessment results will be accurate or complete.

Nothing in these Terms excludes any guarantee, right, or remedy you have under Australian Consumer Law that cannot be excluded.

9. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service, including any loss of data, loss of profit, or harm arising from reliance on information provided by the Service.

Our total liability to you for any claim arising out of or relating to these Terms or the Service will not exceed the amount you paid us in the twelve months preceding the claim, or A$50 if you have not made any payments.

10. Termination

You may delete your account at any time from Account Settings. We may suspend or terminate your account if you violate these Terms or if we discontinue the Service, with reasonable notice where practicable.

On termination, your right to use the Service ceases. We will delete your personal data in accordance with our Privacy Policy.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email or by a prominent notice within the Service at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of Western Australia, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Western Australia.
